According to Zarin when he was questioned by the Planning Board about liability, this law protects FASNY. The legalese is a lot for a layman to digest and understand.

If you build something, you cannot avoid liability by use of the G.O.L. if you screw up. The G.O.L. pertains to the natural and features - usually farms, parks, etc. Peple bike, hike, etc and this protects the land owner, but if you build a bike path, you must maintain it. This would not apply. this would be considered a private school, no matter what they want to call it. It's word play.

Regarding the 3 ways for FASNY to 'get' to be a better neighbor, I prefer the scenario of the whole Read Morething being underground however this does not avoid the traffic concerns. And if it was subterranean it would be underwater literally. Leave White Plains is the best way for FASNY to be a better neighbor. Stop all requests for a special permit and go home.

It's really sad this inane development FIASCO has invaded the lives of so many people for the pastRead More3 years. The final vote draws inexorably near and it's so unlikely these people on the Council will demonstrate the necessary intelligence and good sense to do the right, the obvious thing and say, it's over...NO special permit...thank you goodbye. But the battle continues, as Margaret Mead said, "Never doubt that a small group of thoughtful, committed citizens can change the world; indeed, it's the only thing that ever has." Problem is it takes a lot of money to battle monied interests. There are so many lawyers and investment bankers and slick PR firms involved that the stakes are high...and absolutely highest for the people that live there. Impossible to believe that 2 Council members live in this lovely, special neighborhood and will likely vote for this FIASCO FASNY FOLLY. Please come out early to City Hall this Monday, July 7 to the first public hearing at 7:30.
