Mount Vernon Man Gets 9 Years for WP Train Station Assault

The following is a press release from the Westchester County District Attorney's Office.

Westchester County District Attorney Janet DiFiore announced that Robert France (DOB 04/07/61) of 229 S. 7th Avenue, Mount Vernon, New York, was sentenced today to a determinate term of nine years in state prison on his March 2012 conviction after a jury trial on the top counts if the indictment that charged him with:

  • one count of Assault in the First Degree, a class “B” Violent Felony,
  • one count of Assault in the Second Degree, a class “D” Violent Felony.


On April 12, 2011, at approximately 2:50 am, at the White Plains Metro-North Train Station the defendant accosted the victim with the mistaken belief that the victim has his cell phone. Words were exchanged at which point the defendant began repeatedly striking the victim and hitting him with a large metal garbage can numerous times.

The victim sustained a broken leg which required seven screws inserted into his lower leg.

The victim also required multiple stitches in his left hand and had multiple facial fractures.

He was taken to White Plains Hospital treatment then transferred to Westchester Medical Center based on the severity of his injuries.

MTA Police responded and arrested the defendant.

Assistant District Attorney Alexis Celestin of the Superior Court Trial Division is prosecuted the case.
